Overview


These Terms of Use and Sale ('Terms') govern your use of biltongbutcher.com and our social media channels — Instagram, TikTok, Facebook, and YouTube — (together, the 'Channels'), and any order you place with us. The Channels are operated by Kalahari Khabu Limited (NZBN 9429049849448), trading as The Biltong Butcher ('we', 'us', 'our').


By using our Channels or placing an order, you agree to these Terms. If you do not agree, please do not use our Channels or place an order with us.


These Terms are governed by New Zealand law, and nothing in them limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. See section 12.


We may update these Terms from time to time. The current version is always available on this page. Continuing to use our Channels after an update means you accept the changes.


THE SHORT VERSION


  • You need to be 18 or older to buy from us.

  • All prices are in NZD. We currently ship within New Zealand only.

  • Forever Snack Pack subscriptions: pause, skip, or cancel anytime from your account. No lock-in, no cancellation fees.

  • If something's not right with your order, see our Returns and Refunds Policy, or just get in touch. We're a small, family run business and we'll sort it out.

  • Your rights under New Zealand consumer law are fully protected. Always.

Website and channel use


By using our Channels and agreeing to these Terms, you confirm that you are at least 18 years old, or that you have the consent of a parent or guardian to use our Channels and place orders. You confirm that you have the legal capacity to enter into a binding agreement and that you have read, understood, and agree to these Terms.

Privacy and security


Our Privacy Policy explains what personal information we collect, how we use it, and how we protect it. It is incorporated into these Terms by reference. You can read it at biltongbutcher.com/privacy-policy. We may update our Privacy Policy from time to time, as described in that policy.

Acceptable use and intellectual property


All content on our Channels, including text, images, logos, recipes, and branding, is owned by us or our licensors and protected under the Copyright Act 1994 and other applicable law. Using our Channels does not give you any ownership of, or licence to use, this content, except as set out in these Terms.


You agree not to use our Channels unlawfully. This includes, without limitation: attempting to access, disrupt, or interfere with our website or systems; posting unlawful, defamatory, or obscene content in reviews, comments, or messages; or impersonating any person or business.

Account registration


You may create an account to place orders and manage your Forever Snack Pack subscription. You agree to provide accurate information and to keep your account details, including your password, confidential. You are responsible for all activity under your account. If you believe your account has been accessed without your permission, contact us immediately at info@biltongbutcher.com.

Product information, pricing, and availability


We take care to keep product descriptions, flavours, pricing, and availability accurate and up to date, but errors can occur. If we find a pricing or listing error on an order you have placed, we will contact you before processing it, and you can choose to proceed at the correct price or cancel for a full refund.


All prices are displayed in New Zealand dollars (NZD) and are inclusive of GST where applicable.


We may change our products, flavours, prices, or the availability of any item at any time, and may limit the quantity or availability of any product to particular regions or customers.

Payment


All payments are processed securely through Shopify Payments. By placing an order, you confirm that you are authorised to use the payment method provided, that the information you give us is accurate, and that there are sufficient funds available to cover your order.


We are not responsible for any fees charged by your bank or card provider. If a payment is reversed or disputed without a valid reason, we may seek payment through another method.

Order placement and acceptance


Receiving an order confirmation does not guarantee that we will fulfil your order. We may decline or cancel an order for any reason, including stock availability, suspected fraud, or a pricing or listing error. If we cancel your order, you will receive a full refund to your original payment method, and we will let you know.

Forever Snack Pack subscriptions


If you join the Forever Snack Pack, you are setting up a recurring subscription for biltong delivered to your door.


When you subscribe, you choose your pack size, flavour preference, and delivery frequency (every 2 weeks, every month, or every 6 weeks). You can change any of these at any time through your account.


Your subscription will automatically renew and be charged according to your chosen subscription plan and the chosen frequency. Depending on the plan you can pause a delivery, skip a delivery, or cancel altogether at any time through your account, or by emailing info@biltongbutcher.com. Plans like the 2kg slab + slicer and 4kg slab + slicer have a 12 month contract period while other plans have no lock-in period and no cancellation fee. Please contact info@biltongbutcher.com for further details about your specific subscription.


For the plans that allow it, to avoid being charged for an upcoming delivery, make any changes before your next billing date. The cut off for making any changes to your subscription is 7 days before delivery date.

Shipping and delivery


We currently deliver within New Zealand only. Our Shipping Policy sets out our production cycle, delivery timeframes, and shipping costs in full.


You are responsible for providing an accurate delivery address and contact phone number. We are not responsible for delays or non-delivery caused by incorrect details provided at checkout.


We use tracked courier services for all deliveries. A confirmation of delivery from our courier is accepted as evidence that your order reached the address you provided.

Returns and refunds


Our Returns and Refunds Policy sets out how returns, replacements, and refunds work, including timeframes for unopened products, opened products with a genuine quality issue, and damaged or incorrect orders.


Nothing in this section, or in our Returns and Refunds Policy, limits your rights under the Consumer Guarantees Act 1993. See section 12.

Social media and other channels


This section applies to your interactions with us on Instagram, TikTok, Facebook, YouTube, and any other social media channels we use now or in future.


These platforms are public spaces operated by third parties, and these Terms do not control how they work. Comments and content posted by other users on our channels are their own views, not ours. If you see content on our channels that concerns you, let us know at info@biltongbutcher.com, or report it to the platform directly.

Your consumer rights


REPLACES THE US-STYLE 'DISCLAIMER OF WARRANTIES'


Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other New Zealand law that cannot lawfully be excluded.


If you are buying as a consumer, for personal, domestic, or household use, the guarantees in the Consumer Guarantees Act apply to everything we sell, including that products are of acceptable quality, fit for purpose, and match their description. If a product does not meet these guarantees, you may be entitled to a repair, replacement, or refund under the Act, on top of anything described in our Returns and Refunds Policy.

Limitation of liability


REPLACES THE 'DISCLAIMER OF LIABILITIES' AND USD $500 CAP


To the extent permitted by law, and except for anything that cannot lawfully be limited or excluded, including your rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986, our total liability to you for any claim relating to these Terms or your use of our Channels is limited to the amount you paid for the relevant order.


We are not liable for indirect or consequential losses, such as loss of profits, except where this cannot lawfully be excluded.


Our website is provided on an 'as available' basis. We take reasonable care to keep it accurate, secure, and running smoothly, but we do not guarantee it will always be available, uninterrupted, or free of errors.

Governing law and disputes


REPLACES THE MANDATORY ARBITRATION / CLASS ACTION WAIVER


These Terms are governed by the laws of New Zealand.


If something isn't right, contact us first at info@biltongbutcher.com. We're a small, family run business, we read every message, and most things can be sorted out directly.


If a dispute can't be resolved between us, it may be referred to the New Zealand Disputes Tribunal where it falls within that Tribunal's jurisdiction, or to the courts of New Zealand, which have exclusive jurisdiction over any dispute relating to these Terms.

Indemnification


To the extent permitted by law, you agree to indemnify and hold us, our related companies, and our officers, employees, and contractors harmless from any claims, losses, damages, and reasonable costs (including legal fees) arising from your misuse of our Channels, your breach of these Terms, or your breach of any law or the rights of a third party.

Our Channels may contain links to other websites, including Kalahari Khabu (kalahari.nz), part of the same family-owned business. See our Privacy Policy for more on this relationship. We may also link to other third-party websites or content from time to time. We are not responsible for the content, products, or practices of websites we do not operate, and linking to a website does not mean we endorse it.

Reviews, testimonials, and other submissions


If you send us a review, testimonial, photo, comment, or other content ('Submission'), you confirm that you own it or have the right to share it with us. You give us a worldwide, royalty-free, non-exclusive licence to use, reproduce, adapt, and publish your Submission in connection with The Biltong Butcher, including on our website, packaging, and social media.


We may edit Submissions for length, clarity, or grammar, and we are not obliged to use any Submission we receive. By sending us a Submission, you confirm you have read and agree to these Terms.

Copyright notice


If you believe content on our Channels infringes your copyright under the Copyright Act 1994, contact us at info@biltongbutcher.com with: a description of the copyrighted work; a description and location of the material you believe infringes it; your contact details; and a statement that you believe in good faith that the use is not authorised by the copyright owner or the law.


We will review valid notices and remove or disable access to infringing material where appropriate.

General legal terms


Electronic communications.

You agree that we may communicate with you electronically, including by email, and that these communications satisfy any legal requirement for communication to be in writing.


Assignment.

You may not transfer your rights or obligations under these Terms to anyone else. We may transfer ours as part of a merger, sale, or restructuring of our business, and will let you know if this happens.


No waiver.

If we do not enforce a part of these Terms on one occasion, that does not mean we give up the right to enforce it later.


No agency relationship.

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and us.


Severability.

If any part of these Terms is found to be unlawful or unenforceable, that part will be limited or removed to the minimum extent necessary, and the rest of these Terms will continue to apply.


Termination.

We may suspend or end your access to our Channels or your account at any time, including if we reasonably believe you have breached these Terms. Provisions relating to your consumer rights, liability, governing law, intellectual property, and anything else which by its nature should continue, will survive the end of these Terms.


Entire agreement.

These Terms, together with our Privacy Policy, Shipping Policy, and Returns and Refunds Policy, make up the entire agreement between you and us about your use of our Channels and any order, and replace any earlier agreements or understandings.
